Extraordinary Ability Aliens

HSPRD attorneys have extensive experience assisting foreign national obtaining lawful permanent residence status as aliens of extraordinary ability.  To qualify for lawful permanent residence based on extraordinary ability, a foreign nation must demonstrate their extraordinary ability in their field of endeavor has received sustained national or international acclaim.  If an individual has been awarded a Nobel Prize, an Academy Award, a Pulitzer Prize, or other similar major award in their field of expertise, that award in itself generally meets the threshold for demonstrating extraordinary ability.  Alternatively, evidence of that the foreign national at least 3 of the following criteria must be presented:

 

  1. Receipt of lesser national meets or international prizes or awards for excellence in the field;
  2. Membership in associations in the field that require outstanding achievement for their members, as judged by recognized national or international experts;
  3. Published material in professional or major trade publications or major media about the individual and their achievements;
  4. Participation on a panel or as a judge of the work of others in the same or an allied field of specialization;
  5. Original scientific, scholarly, or business-related contributions of major significance;
  6. Authorship of scholarly articles in professional journals or other major media;
  7. Display of the individual’s work at artistic exhibitions or showcases;
  8. Performance at a leading or critical role for organizations with a distinguished reputation;
  9. Commanding a high salary or remuneration in comparison with others in the field of endeavor, as evidenced by contracts or other reliable evidence; or
  10. Commercial success or sales in the performing arts, as evidenced by box office receipts or sales.

 

Where the listed criteria do not readily apply, other comparable evidence of extraordinary ability can be presented.  The USCIS will evaluate the evidence presented to determine if in the aggregate the evidence establishes that the individual has demonstrated their extraordinary ability through national or international acclaim.
